This agreement outlines the terms on which iBuyWeSell offers you access to our products and services.

Using iBuyWeSell

You are solely responsible for all information that you submit to iBuyWeSell and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or is breaching the applicable terms. We also reserve the right at our discretion to restrict a user's usage of the site either temporarily or permanently, or refuse a user's registration.

• Age: You have to be 18 years or older to use the services provided by iBuWeSell (“Services”).
• The equipment (mobile, computer, software, telecommunications systems, etc.) used to access to Services is the your responsibility, and so is also the costs for telecommunications and other costs incurred by its use.
• Responsibilities: The advertiser is responsible for the posted ad. iBuyWeSell is not responsible for the posted goods or service or for the responses and offers provided through iBuyWesell
• Copyright: All rights to the ad text and images are transferred to iBuyWeSell AB.
• Compensation: If technical or handling errors occur, that makes it impossible for you to make use of the Service, then the compensation for the failure will in no event exceed the cost of the ad. iBuyWeSell is not responsible for any other cost or damage.
• E-mail: If you wish to advertise without stating your phone number, you may select the “hide number option”. In such case your e-mail address is mandatory.

Your responsibilities

As a condition of your use of iBuyWeSell you warrant that you will not:

• violate or breach any laws or regulations
• violate the Posting Rules
• post any threatening, abusive, defamatory, obscene or indecent material
• provide false or misleading information
• infringe any third-party right
• distribute or contain spam, chain letters, or pyramid schemes
• distribute viruses or any other technologies that may harm iBuyWeSell or the interests or property of iBuyWeSell users
• impose an unreasonable load on our infrastructure or interfere with the proper working of iBuyWeSell
• copy, modify, or distribute any other person's content without their consent
• use any robot spider, scraper or other automated means to access iBuyWeSell and collect content for any purpose without our express written permission
• harvest or otherwise collect information about others, including email addresses, without their consent
• bypass measures used to prevent or restrict access to iBuyWeSell

Fee & Services

When you place an Ad or Ads via iBuyWeSell service, Ad placement is free of charge. However, you will have to pay a fee to receive the contact information of the persons who are interested in responding to your Ad. Such fees are available at www.ibuywesell.com/fees. Upon your payment of the applicable fees, you will receive contact information of the persons who have responded to your Ad. At the same time, they will also receive access to your contact information. Both you and the interested parties will receive the information as long as the Ad is active on iBuyWeSell.

You will only pay the fee one time for receipt of the first response. No additional fees are charged thereafter for responses to your ad, provided however that you do not make any material modifications to you ad. You may not modify the object you are advertising, but you may modify the price and other similar details.

Our fees will be subject to change from time to time. The current fees are available at: www.ibuywesell.com/fees. You will be responsible for paying applicable fees in accordance with the terms that are valid at the time of your use of the Service. You will pay the fee by means as specified by iBuyWesell at www.ibuywesell.com/fees. Normally the fees are charged through payment in connection to your phone bill or by means of premium SMS.

You will receive responses to your ad until the ad is no longer available on iBuyWesell. You can remove the ad at any time by logging into your account. It is your responsibility to remove the ad when the ad is no longer valid. iBuyWesell will remove your ad after three (3) months. If you wish to place a new ad for the same object after such removal, then you may do so free of charge, but you will have to pay a new fee for receiving access to responses to your ad. The same applies if you wish to place a new ad for another object.

Please note that your geographical position is made available in your Ad. Information of your geographical position will be stored as you personal information until your information is destroyed.

When you respond to an Ad, your contact information will be forwarded to the person who placed the Ad. You will also receive contact information to such person. You must comply with the terms and policies stated in this document or otherwise provided by iBuyWeSell while responding to Ad.

Content – Posting rules

• Private ads: The private ads are for private persons who have the right to make contracts according to the applicable laws and regulations.
• Business ads: Make sure your ad has VAT included in the price.
• No marketing: It's only allowed to post ads under for sale, rent, exchange, services and wanted and any other categories that may be provided by iBuyWeSell from time to time. No general marketing without specific offering is allowed.
• Services: Ads for services must abide applicable laws.
• Description: Your headline should describe the goods or service as correct as possible. Describing texts cannot be copied from other ads, they are protected under applicable copyright act. Only ads in Swedish, Norwegian, Danish or English are allowed.
• Categories: Your ad should be placed under the category that best describes your goods or service. Only one vehicle or housing per ad is allowed.
• No doublets are allowed. You can only post one ad per goods or service. Erase the old ad before posting a new ad.
• Links: It's not allowed to post links in the ads.
• Images: Images should be relevant for the goods or service posted. It is not allowed to use images from other ads, unless you have permission, they are protected under applicable copyright act.
• Piracy and forgery: It is not allowed to post ads with piracy goods, copies or fake products.
• Animals: iBuyWeSell follow the law on animal welfare and recommendations for their sale
• Weapons: Only weapons with license are allowed and the text in the ad must state that license is required.
• Illegal goods: Goods or services that are forbidden by Swedish law are not allowed.
• Offensive content: Ads that are offensive to individuals or ethnic groups are not allowed.
• Modification or addition of goods or service: Modification or addition of goods or services or other objects in your ad is not allowed.
• Since video content is uploaded on YouTube, you must agree to the YouTube Terms of Use

These rules are updated and might change from time to time. By making continued use of the Service you accept the modifications and agree to comply with such.

Our right for removal your material

We may withdraw or alter any content you provide us (including any ad you submit and if you are a seller, your ad) if:

1. we reasonably consider it is inappropriate, offensive, misleading or deceptive, defamatory, incorrect or in any other way in breach of the Use terms (including any rules, guidelines or policies), any law or third party right
2. we are instructed to do so by any third party, or
3. the content otherwise is in conflict with our policies, as amended from time to time.

We also reserve the right to select, edit, condense, determine the duration of, change the nominated “category” of, withdraw or refuse your Ad.

We will use commercially reasonable efforts to notify you if we withdraw or alter any material you provide us.

Mobile Services

iBuyWeSell may offer the Services through mobile applications created by it or third party developers (“Platform Developers”). If you use the Services through a mobile device, you agree that information about your use of the Services through your mobile device and carrier may be communicated to us, including but not limited to your mobile carrier, your mobile device, or your physical location. In addition, use of the Services through a mobile device may cause data to be displayed on and through your mobile device. By accessing the Services using a mobile device, you represent that to the extent you import any of your iBuyWeSell data to your mobile device that you have authority to share the transferred data with your mobile carrier or other access provider. In the event you change or deactivate your mobile account, you must promptly update your iBuyWeSell account information to ensure that your messages are not sent to the person that acquires your old number and failure to do so is your responsibility. You acknowledge you are responsible for all charges and necessary permissions related to accessing iBuyWeSell through your mobile access provider. Therefore, you should check with your provider to find out if the Services are available and the terms for these services for your specific mobile devices.

Finally, by using any downloadable application to enable your use of the Services, you are explicitly confirming your acceptance of the terms of the End User License Agreement associated with the application provided at download or installation, or as may be updated from time to time.

Limitation of liability

You will not hold iBuyWeSell responsible for other users' content, actions, or inactions. You acknowledge that our site is a market place where anyone can offer, sell, and buy just about anything, at anytime, from anywhere, in a variety of pricing formats and locations. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety, or legality of items advertised, the truth or accuracy of users’ content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction or return an item. We do not transfer legal ownership of items from the seller to the buyer. We cannot guarantee continuous or secure access to our sites, services, or tools, and operation of our sites, services, or tools may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising, directly or indirectly, out of your use of or your inability to use our site.

Regardless of the previous paragraphs, if we are found to be liable, our liability to you or to any third party is limited to the total fees you paid to us in the 12 months prior to the action giving rise to the liability.

If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

You acknowledge and agree that the information on the site and/or information provided by us to you may be incomplete, incorrect or otherwise defective. We accept no responsibility for such errors.

Disputes and Governing Law

Any dispute, controversy or claim arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by Swedish courts.

The seat, or legal place shall be, Stockholm, Sweden.

The governing law of this Agreement shall be the substantive laws of Sweden.

Indemnify

You agree to indemnify and hold iBuyWeSell (and our officers, directors, agents, subsidiaries and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

Copyright

Copyright in the content on the iBuyWeSell site and in the iBuyWeSell site itself (as a compilation of information) is owned by iBuyWeSell, our advertisers or content suppliers.

iBuyWeSell is a database protected by upphovsrättslagen. This means that it is forbidden, without permission from iBuyWeSell, to create copies/make public of the content on iBuyWeSell.

The layout of the web site as well as copywriting and images might be protected by upphovsrättslagen. All photographies are protected by upphovsrättslagen. If you create copies without permission you are violating upphovsrättslagen. If you publish the copy you are committing a second crime since you are making the copy available to the public.

It is allowed to link to iBuweSell.com, however you are not allowed to index our content and based on this generate links on your own web site. You are not allowed to place iBuyWeSell into a frame system or Pop-up window. Also consider that there might be others who have the right to certain content and if so you have to ask for their permission.

It is not allowed to use our ads for your own marketing purposes. It is forbidden by law to send email or SMS to private persons without their permission.
